OZARK CITY COUNCIL REGULAR SESSION
March 12, 2018
5:30 p.m.
Mayor McNutt opened the council meeting at 5:30 p.m. Present: Mayor McNutt, Clerk Eveld,
Attorney Jeff Phillips, Alderpersons Warden, Holman, Hall, Patterson, Anderson, and Waters.
Hall Gave the invocation and Patterson led the pledge.
All were present. Mayor McNutt welcomed everyone and called the meeting to order.
Hall motioned to approve the minutes and financial statements, seconded by Waters, On a roll vote,
Aye: Holman, Hall, Anderson, Patterson, waters, and Warden. No Nays.
Committees- None reported
Commissions: Parks and Rec met February 22 nd to follow up on the soccer field and skate park. April
2 nd, Saturday from 7:45 through 9:00 a.m. swim team will be at the pool. Also on Mondays 7:00 am to
8:30 a.m. Mondays, Tuesdays, and Wednesday during summer they will be 7:45 – 9:00 a.m.
On the 8 th of April there will be a mandatory meeting with lifeguards to discuss scheduling issues.
Tom Forrester will be there to discuss classes of yoga and water aerobics.
They also want to discuss pickle ball. Next Roxie said that it came up that a couple of people wanted
refunds for memberships, and she said we cannot do that. She said silver dollar city or white water,
and we can’t do that either. Hall made a motion to not allow refunds for memberships to the Ozark
Community center seconded by Patterson. On a roll vote, Aye: Holman, Hall, Anderson, Patterson,
waters, and Warden. No Nays.
City attorney Philips said it needs to be included in our policy book.
Department Heads:
Cecil reported first that spring street will be closed a couple of days so an 8-inch water line can be
repaired, then the street can be repaired. There will be two days next week also.
Jody then reported that as requested by the city attorney, he has the costs estimated of tearing
down those houses that were condemned. Jeff asked for the copies and will get with Jody about
what to do next.
Next Devin reported that Reed will go back to being the animal control officer and he has an ad in the
paper advertising for an officer to fill the patrol position.
Next Kevin said that the building committee met but there wasn’t a quorum so he passed out a
layout to council of what the new fire station will look like. He asked for permission to begin taking
bids. He said the street department would do some dirt work but they s hot a grade for it. Holman
motioned to take bids for the new fire station seconded by warden. On a roll vote, Aye: Holman,
Hall, Anderson, Patterson, waters, and Warden. No Nays.
That will be for concrete, fill, gravel, the actual building, asphalt, and everything connected to
erecting a new fire station.
Dwayne brought up the building on airport road that’s for sale for approx. $170,000 but Susan
suggested we go with building on the property we bought on 18 th street. She asked how long it
would take and Eveld said around 4-6 months.
Eveld then asked for bids on new turnouts and air packs. He said the newer ones are safer and
have a built in thermal imagers. He has 17 sets of sbca’s but needs 8 – 10 of the improved versions
for structure fires. He is asking to take bids and wants the building committee to meet before the
next council meeting. Holman motioned to take bids on turnouts and SCBA; s seconded by Hall.
On a roll vote, Aye: Holman, Hall, Anderson, Patterson, waters, and Warden. No Nays.
NFPA has determined that turnouts need to be replaced every 10 years.
Kevin passed out state bids sheet for a vehicle for Nick. $26,783.45. he said they would
keep the old truck and use it to pull water to grass fires. Then he handed out a pic of a brush
truck that has already met the bid process through HGAC and he would like to purchase it
for the new station. It costs $197865.00. bids are not necessary. It can fight fires without
getting out of the vehicle on interstates and sprays from the front and back. Alma has one
and loves it. Very safe. Next there is a pumper made by pierce for $412,000 which is a
demo for sale. He said a new one built to order would cost $465K and the city could save
$20K by prepaying. The truck is in Kansas and they will bring it here for council or the
committee to look at. The council set the next police and fire committee meeting for March
29 th at 5:00 p.m. at council chambers.
Kevin will invite Peirce to bring the truck from Kansas to show at the meeting.
Old Business:
Pool Lamps. Jody talked about this last month and said they already have $80,000 in the lamps and it
must be maintained. He said it is $1200 per lamp and we have four. Holman motioned to approve
the annual contract with Sunbelt to maintain the Pool Lamps, seconded by Hall. On a roll vote, Aye:
Holman, Hall, Anderson, Patterson, waters, and Warden. No Nays.
Next Chris brocket updated council on the U.P. Lawsuit. He said District Court dismissed the case and
the city is out of options. We received a letter stating the case is officially over. He did say that the
attorney general is looking at it but the STB ruled.
New Business:
Area Agency sent a report showing how they are spending the funds provided by the city. No one
from the agency was there.
Next Jeff Read Ordinance 2018-1 to rezone 1607 Airport Road to I1. A motion to approve was made
by Holman seconded by Warden. On a roll vote, Aye: Holman, Hall, Anderson, Patterson, waters, and
Warden. No Nays.
Hall motioned to dispense with second and third readings and read by title only. Holman seconded.
On a roll vote, Aye: Holman, Hall, Anderson, Patterson, waters, and Warden. No Nays.
Jeff read by title only Ordinance 2018-1. Holman motioned to adopt seconded by Hall. On a roll vote,
Aye: Holman, Hall, Anderson, Patterson, waters, and Warden. No Nays.
Next Jeff Read Ordinance 2018-2 to rezone 1607 Airport Road to I1. A motion to approve was made
by Holman seconded by Waters. On a roll vote, Aye: Holman, Hall, Anderson, Patterson, waters, and
Warden. No Nays.

Mayor McNutt hen announced the spring cleanup which will be April 2 nd -6 th and there will also be an
e-waste disposal location east of the Jail by the recycling center. Green Source does our e-waste
cleanup.
Public Input:
Anna Underwood took he podium and announced she wants to put in a memory garden near the
community center on behalf of her son who passed away recently. He was in the class of 1988 and
the class wants to establish a memory garden in his memory. She said the scouts will help maintain
the garden to earn badges. She said also there will be a 12×12 stone.
Parks and Rec will take this under advisement and will notify Ms. Underwood of their decision and
the meeting time.
Chris Brockett announced that the plans for the marina to the Corps. Steve Outlaw is taking over the
grant.
Hall welcomed Cindy Kramer and students from the Ozark high school who are visitors to the council.
Everyone applauded to welcome them.
Next Steve Whiteaker took the podium and said that he feels rubbed the wrong way on a spiritual
level. He stated that the council says yes to all expenditures and just because the money is there
doesn’t mean we have to spend it. He stated the poverty levels and felt it was sad that we were
spending money.
Kevin Eveld then took the podium and said that he wanted to tout some positive things happening in
our city. He said the school just built new schools, the community center was built, we just passed
two ordinances to bring in a factory which will bring in jobs, REA is rebuilding and the bank has
projects going on. He wants us to end on a positive. Every applauded.
A motion to adjourn was made by Holman, seconded by Waters On a roll vote, the following voted:
