TITLE 3 S-3 FISCAL AFFAIRS Cha tp ers: 3.04 Purchases 3.08 Real Estate and Personal Property Taxes 3.12 Fixed Assets CHAPTER 3.04 PURCHASES Sections: 3.04.01 Authority 3.04.02 Under$10,000 3.04.03 Over$10,000.00 3.04.04 Approval of payments 3.04.05 Sale or exchange of supplies, materials or equipment valued at less than$1,000.00 3.04.06 Exceptional situation 3.04.01 Authority The Mayor or his duly authorized representative shall have exclusive power and responsibility to make purchases of all supplies, apparatus, equipment, materials and make contracts for work or labor and other things requisite for the benefit of the city of Ozark. (Ord. No. 95-12, Sec. 1.) 3.04.02 Under$10,000 All purchases for the city of supplies, apparatus, equipment, materials, and other things requisite for public purposes where the expenditure therefore is in excess of Two Thousand Dollars ($2,000.00) but less than Ten Thousand Dollars ($10,000.00) shall be made by the Mayor, or his duly authorized representative, after the securing of quotation bids therefore; provided, however,purchases of less than Ten Thousand Dollars ($10,000.00) at state bid prices shall be exempt from the provisions of this ordinance. (Ord.No. 95-12, Sec. 2.) 28 S-3 3.04.03 Over$10,000.00 Where the amount of expenditure for any purchase or contract exceeds the sum of Ten Thousand Dollars ($10,000.00), the Mayor or his duly authorized representative shall invite competitive bids thereon by legal advertisement in any local newspaper. Bids received pursuant to said advertisement shall be opened and read on the date set for receiving said bids, in the presence of the Mayor, or his duly authorized representative. The contract shall be awarded to the lowest responsible bidder; provided, however,the Mayor, or his duly authorized representative, may reject any and all bids received. (Ord.No. 95-12, Sec. 3.) 3.04.04 Approval of payments The Mayor or his duly authorized representative may approve for payment out of any funds previously appropriated for that purpose, or disapprove any bills, debts or liabilities asserted as claims against the city, when funds on hand are adequate to pay such bills, debts or liabilities. The payment or disapproval of any bills, debts or liabilities not covered by a previous appropriation shall require confirmation of the governing body. (Ord. No. 95-12, Sec. 4.) 3.04.05 Sale or exchange of supplies materials or equipment valued at less than $1,000.00 The Mayor or his duly authorized representative, may sell or exchange any municipal supplies,material or equipment without competitive bidding if such supplies, materials or equipment have a value of less than One Thousand Dollars ($1,000.00). No supplies,materials or equipment shall be sold without receiving competitive bids therefore fit the value thereof exceeds the sum of One Thousand Dollars ($1,000.00); provided however, if the Mayor shall certify in writing to the governing body that, in his opinion,the fair market value of such item or lot(to be disposed of in one unit) is less than One Thousand Dollars ($1,000.00),the same may be sold by Mayor without competitive bidding. No. 2003-7, Sec. 1.) 3.04.06 Exceptional situation The City Council of the city of Ozark may, after a finding that an exceptional situation exists and that competitive bidding is not practical or feasible, waive,by ordinance in each exceptional situation, the requirements of competitive bidding. (Ord.No. 2003-7, Sec. 2.) CHAPTER 3.08 REAL ESTATE AND PERSONAL PROPERTY TAXES Sections: 3.08.01 Taxes 29 S-3 3.08.01 Taxes A. A tax of five (5)mill is hereby levied by the City Council of the city of Ozark, Arkansas, for the benefit of the General Fund on all real estate and personal property within the city of Ozark, Arkansas, for the year 2013. (Ord. No. 2012- 13, Sec. 1.) B. A tax of one (1)mill is hereby levied by the City Council of the city of Ozark, Arkansas, for the express benefit of the Ozark Firemen's Pension Fund on all real estate and personal property within the city of Ozark, Arkansas, for the year 2013. (Ord.No. 2012-14, Sec. 1.) C. A voluntary tax of one and two-tenths (1.2)mills is hereby levied on all real estate and personal property in the city of Ozark, Arkansas, for the use and benefit of the city of Ozark, Arkansas, Volunteer Fire Department for the year of 2013.
