OZARK CITY COUNCIL REGULAR SESSION September 9, 2019
5:30 p.m.
Mayor Hall called the council meeting to order at 5:30 p.m. Present: Mayor Hall, Clerk Eveld, Attorney Kevin Barham, Alderpersons Anderson, Flanary, Holman, Meeker, Melton and Nicely.
Brother Thomas from Web City Baptist led the invocation and the youth led the Pledge.
A motion was made to approve the minutes and financials was made by Meeker, seconded by Melton. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Committees & Commissions Reports:
Randy Melton reported that Street and Water Committee met on September 3rd and said the PV Contract was at the attorney’s office to be reviewed. The west end cleaning of the water tank is on hold and water meters need to be upgraded. The alley on third street is back opened behind the donut shop because the building in danger of collapse has been secured. Paving will begin next week on several streets, and the improvements on hillbilly lane are completed. Many street signs need repair and this work will begin. Also, the butterball plant needs its entrance changed.
Next Rex from Personnel and Policy said they did not meet but a meeting is scheduled for the 19th at 4:30.
No budget meeting to report on but the next one will be Sept 19 at 5:30.
Susan set up a police and fire meeting for Sept 19th at 4:30. Budget committee will meet with council and department heads to work out the needs per each department. This will be held on the 19th at 5:30.
Commissions: Ruth Hoffman reported that P&Z met on September 5th at 6:30. They unanimously approved the rezone at 207 N 6th to pave the parking lot for the BankOzk. Also the commission made a recommendation to approve a variance for the hospital to build a dumpster area. They will meet again October 3rd. Holman moved to read ordinance 2019-18 to rezone 207 N 6th seconded by Nicely. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Barham read Ordinance 2019-18. A motion to dispense with the second and third readings and read by title only was made by Anderson seconded by Meeker. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Barham read ordinance 2019-18 by title. A motion to approve was made by Holman seconded by Anderson. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, and Nicely. Melton Abstained.
A motion to approve the emergency clause was made by Holman seconded by Anderson. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, and Nicely. Melton abstained.
Next Mercy Hospital showed council pictures of the dumpster location. A motion to approve the variance was made by Anderson seconded by Melton. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Department Heads:
Police Chief Devin Bramlett reported the ordinance committee will be Tuesday the 17th at 5:30.
Nick reported that the roof on 3rd street has been secured and the road on College was reopened as well as the alley behind the do nut shop. Several buildings downtown are in need of repair and he advised building owners to inspect for damages. He said he and Jason were inspecting these buildings to avoid further issues.
The department responded to 433 calls not counting inspection calls.
Trotter said that the 18th will mark the 18 anniversary of the 911 terrorist attacks which cost many people and police and fire personnel their lives. He asked everyone to be in prayer for families of victims.
Cecil then reported that the 2018 audit is complete, and he passed those out to council. He said there were no major issues. Council had no comments or discussion. He said the water meters need upgraded and he will come back to council with more information and prices next month. His dump truck is needing to be replaced. It is the 99 Ford. A motion to approve the 2018 water audit was made by Anderson seconded by nicely. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Jody reported that the street repairs are in the works and he would be prepared to bid out. the sidewalk grant has been certified for its right of way and they should be ready to proceed.
Old Business:
Housing Authority needs approval with the date of contract correction. Holman moved to approve Lisa Tolbert seconded by Nicely. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Next a motion was made to Gar Creek Lane to the agenda by Nicely seconded by Meeker. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Mayor Hall said this has been in the works for some time and Barham has worked on this. She said its not an easy decision, but the city has no documentation that this was ever approved as a city street. If we pave it the precedence will be set and other individuals will expect private property to be paved as well, and we cannot do that. Attorney Barham said its ultimately the mayor’s decision but paving it would open the city up for lawsuits. Roy Day wants to know where Gar Creek lane stops and starts. Roxie said he have no documentation at this time. Vernon said the former street superintendent said it was paved to the pavement. Barham stated that the road may be a public way but that doesn’t make it a city street.
New Business:
Ordinance 2019-19 Firemen’s Pension Tax Levy.

Artup was next on the agenda and Kathy Mason explained who they are and what they do. They aim to bring the arts to the area and invite everyone to participate. They are having a fund raiser on May 30th, 2020 and ask for citizens and city to support this event.
Resolution 2019-22 Improvements to ATU Ozark Walking Trail
A motion to read was made by Melton seconded by Holman. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.
Barham read Resolution 2019-22. A motion to adopt was made by nicely seconded by Holman. On a roll vote, the following voted: Aye: Anderson; Flanary, Holman, Meeker, Melton and Nicely.

Fall cleanup will be October 7-11. Also, she wanted to note that the November council meeting will fall on veteran’s day and she want to honor the veterans on that day and move the November council meeting forward one week to November 18th.
