MINUTES OF THE REGULAR MEETING
OF THE OZARK CITY COUNCIL
SEPTEMBER 14, 2020
OZARK CITY COUNCIL MEETING ROOM
A regular meeting of the Ozark City Council was held on September 14, 2020 at 5: 30 p. m. at the Ozark City Council Meeting Room. Present were Mayor Roxie Hall, City Attorney Kevin Barham, City Clerk Susan Stevens, and Alderpersons Brandy Flanary, Susan Holman, Charles Meeker, Randy Melton, and Aerial Nicely. Alderman Rex Anderson was not present. Call to Order by Mayor Hall. Grant Nicely gave the Invocation and Mayor Hall led the Pledge of Allegiance.
Upon a roll call, a quorum was declared to exist for the meeting. Randy Melton moved for approval of the minutes from the August meeting, seconded by Charles Meeker. All Alderpersons present voted aye and the minutes were approved.
Financials: Susan Holman asked that a monthly report be included too, along with the year- to-date. She will talk to Marla to see if this can be done. There was also a question regarding the amount paid for a part- time pool salary during the closure. A motion to approve the Financial Report was made by Susan Holman and seconded by Aerial Nicely. All Alderpersons present voted aye and the Financials were approved.
Sarah Capp, District Court Judge ” Elect” gave a presentation of the Transition to State Court that will begin January 1, 2021. Topics such as a District Court Overview, a Proposed Schedule, 2020 Issues, a table per city of uncollected Misdemeanor Warrants/ Payment Policy, and the Cost Sharing Statute.
Jason Fitzgerald from CARDS spoke regarding the Fall City Wide Residential Clean Up. Residents with proof of a current City water bill shall be allowed to dispose of one pickup truck load or equivalent not to exceed 3, 000 lbs. of bulky waste items at the City Transfer Station. He stated that residents bringing it in themselves eliminates his employees having to have contact with the waste items, and they are better able to check loads for items that are not allowed. Mayor Hall asked if this decision could be revisited in the Spring, but Mr. Fitzgerald did not respond. The schedule for Fall Clean- up will be on October 9th and 10th. He is to run a notice in the newspaper. The Drop-Off bins for recycling have been removed from downtown. Curbside service will be on the 2ndand4thFriday of each month for City residents. Residents may pick up two bins per family at City Hall and should call CARDS to be added to their pick- up schedule.
Chief of Police Devin Bramlett presented a Lifesaver Award plaque and certificate to Officers Grant Nicely and David Warren.
Old Business: Ordinance 2020- 8
Devin Bramlett stated that he has been working on a form of this Ordinance since 2016. There have been 6 Committee meetings this year and only 2 citizens have expressed any interest in it and only 2 extra copies have been requested.
City Attorney Kevin Barham stated that the major changes are 1) updated definitions, 2) procedures added for enforcement, 3) Procedures for due process under the 5th Amendment, and 4) a process to locate the property owners due to the death of original owner through the Tax Office or City Hall. He also state that this version has more authority to recoup financial losses and solve the problem ( Section 12 of Ordinance).
Charles Meeker questioned if this was the updated copy. Devin had sent out a newer one on September 3rd. Aerial Nicely took Mr. Barham’ s copy to make copies for those present.
A short recess was declared.
Devin Bramlett presented a request to purchase a Voice Recorder for the Police Department Offices from Equature ( Interactive Public Safety Response). Every call could then be recorded to verify complaints and reports. Pinnacle has stated that it is compatible with our current systems with 30 days to install and train. Charles Meeker asked if it was for all phones at City Hall? No, just the Police Department. There were two payment plans presented— a pay in full, and a 5 year plan. Susan Holman noted that the 5 year plan is less expensive. Chief Bramlett stated that the Police Department has the money in their budget to pay for it, but he wanted to present it to the Council so they are aware. All Council members approved this Police Department expenditure.
Mrs. Nicely returned with the Ordinance 2020-8 copies and discussion resumed. Susan Holman made a motion for the Ordinance to be read, seconded by Charles Meeker, with all Council members present voting aye. Mr. Barham proceeded in reading the Ordinance. Randy Melton made a motion to suspend second and third readings and read by title only. This was seconded by Susan Holman and all Council members present voted aye.
This Ordinance 2020-8 being necessary for the preservation of the public peace, health, and safety, an emergency is hereby declared to exist, and this Ordinance 2020- 8 shall be in full force and effect from and after its passing, Motion to approve made by Susan Holman and seconded by Aerial Nicely. A roll call vote of the Council was made with all present members voting aye. Ordinance 2020- 8 was approved.
Public Input:
Jacob Debes presented that he is still interested in the position of Water Department Supervisor and stated that Cecil Zolliecoffer has offered to tutor him free of charge in any training that is needed.
Announcements:
Of the 49 Water dis- connect notices that were sent out due to non- payment, all but 4 have been resolved.
A meeting regarding City Plans for Halloween is coming up soon.
Adjournment:
A motion to adjourn was made by Aerial Nicely and seconded by Randy Melton. All Council members present voted aye and the meeting was adjourned.
