MINUTES OF THE REGULAR MEETING
OF THE OZARK CITY COUNCIL
OCTOBER 12, 2020
OZARK CITY COUNCIL MEETING ROOM
A regular meeting of the Ozark City Council was held on October 12, 2020 at 5: 30 p. m. at the Ozark City Council Meeting Room. Present were Mayor Roxie Hall, City Attorney Kevin Barham, City Clerk Susan Stevens, and Alderpersons Rex Anderson, Brandy Flanary, Susan Holman, Randy Melton, Charlie Meeker, and Aerial Nicely. Welcome and Call to Order by Mayor Hall who led the Invocation. Marla Ward then led the Pledge of Allegiance.
Upon a roll call, a quorum was declared to exist for the meeting. Charlie Meeker moved for approval of the minutes after requesting a correction in the September Minutes. During that meeting, Susan Holman made the motion to read Ordinance 2020- 8. Randy Melton seconded the motion, not Mr. Meeker as stated in the Minutes. Alderperson Randy Melton seconded the motion made by Mr. Meeker to approve the September Minutes. Upon a roll call vote, all Alderpersons voted aye, and the September Minutes were approved.
Financials: A motion to approve the Financial Report was made by Charlie Meeker and seconded by Aerial Nicely. Upon a roll call vote, all Alderpersons voted aye and the Financial Report was approved. There was discussion regarding a 2018 deposit of$ 8500. 00 into a Bank OZK account that was unaccounted for. Mayor Hall has spoken to Dawn at the Bank, and the deposit was made as an attempted fraud. Our account has been closed, and the money turned back over to Bank OZK.
Parks& Recreation Commission report given by Aerial Nicely. At their meeting they had discussed continued improvement to City Parks, lighting for the soccer fields and possibly installing restrooms for the soccer fields in the old Street Department Building. A sink and table have been put in one of the party rooms in the Community Center. There was also a refrigerator installed that was donated by a local business The Furniture Store. Discounts for the Community Center were then discussed. The Silver Sneakers program is available offering a discount to Senior Citizens. The Commission would like to extend a 20% discount to members of the military. Motion made to approve this discount by Randy Melton and seconded by Brandy Flanary. Upon a roll call vote, all Alderpersons voted aye and the discount was approved. Our party room currently rents for$ 25. 00 per hour. A basketball party is$ 25.00 for 10 children. Wrist/ Arm Bands were discussed as a way to tell what activity that patrons have paid for. There have been reports of theft from the lockers, there are some locks available and patrons are encouraged to use them, but most don’ t. An option of bringing their own locks was discussed. Brooke Rosson, Community Center Director would like to have a Men’ s Basketball Tournament possible in January as a Benefit for the Center. There will be a Fall Break Special October 16, 17, 18, & 19 with a $ 3. 00 swim fee.
Ordinance Committee Report given by Devin Bramlett. At their meeting a Building Permit fee system was discussed and an ordinance brought up to bring Ozark in line with Industry Standards.
Street& Water Committee Report was given by Rex Anderson. They had discussed how to use money left over in their budget. Possible road resurfacing and repair were mentioned. Faye Hurt from the Water Department has turned in her resignation. A notice was posted in the Spectator and applications will be taken until noon on October 23rd
Michael Morrison from Congressman Bruce Westerman’ s office was unable to attend tonight’ s meeting.
Adele Jacobs with King, Jacobs, & Lorfing, CPA, then reviewed the results of the 2019 Water& Sewer Department Audit. She stated that all books and records were in order and all information requested was accounted for.
A motion to read Resolution 2020- 13 was made by Aerial Nicely and seconded by Charlie Meeker. Upon a roll call vote, all Alderpersons voted aye and City Attorney Kevin Barham read the Resolution which will replace Cecil Zolliecoffer with new Water Department Superintendent Tonya Talkington as a signatory on all city bank accounts. A motion to approve the Resolution was made by Susan Holman and seconded by Rex Anderson. Upon a roll call vote, all Alderpersons voted aye and Resolution 2020- 13 was approved.
A motion was made to read Ordinance 2020- 11 by Susan Holman and seconded by Aerial Nicely. Upon a roll call vote, all Alderpersons voted aye and the Ordinance was read by Mr. Barham. Rex Anderson brought up possibly passing an addendum at a later date to better clarify permit fees. A motion was made to dispense with the 2″ dand3rdreading by Rex Anderson and seconded by Aerial Nicely. Upon a roll call vote all Alderpersons voted aye. A motion to approve Ordinance 2020- 11 was made by Susan Holman and seconded by Rex Anderson. All Alderpersons voted aye. A motion was then made to enact the Emergency Clause by Charlie Meeker and seconded by Aerial Nicely. All Alderpersons voted aye and Ordinance 2020- 11 was approved.
David Mahon brought Ordinance 2020- 12 which will rezone 211 N. 6th Street from R1 to C2. A motion to read was made by Susan Holman and seconded by Charlie Meeker. All Alderpersons voted aye and the Ordinance was read by Mr. Barham. A motion to dispense with the 2″ d & 3rdreading was made by Randy Melton and seconded by Rex Anderson. All Alderpersons voted aye. A motion was made to approve Ordinance 2020- 12 by Susan Holman and seconded by Randy Melton. All Alderpersons voted aye. A motion was then made to enact the Emergency Clause by Rex Anderson and seconded by Charlie Meeker. All Alderpersons voted aye and Ordinance 2020- 12 was approved.

All Alderpersons voted aye and Mr. Barham read the Ordinance. A motion to dispense with the 2nd& 3rd reading was made by Charlie Meeker and seconded by Randy Melton. All Alderpersons voted aye. A motion was then made to approve Ordinance 2020- 13 by Susan Holman and seconded by Charlie Meeker. All Alderpersons voted aye. A motion was made to enact the Emergency Clause by Susan Holman and seconded by Randy Melton. All Alderpersons voted aye and Ordinance 2020- 13 was approved.
Mayor Hall then presented Employees of the Quarter( July-August- September). Water Department David Williams, Street Department Daniel Alexander, Fire Department Roy Sampley, Police Department Hallie Russell, and the Community Center Caleb Martinez.
Special Thanks to our police, fire and emergency personnel on an outstanding job on Wednesday, September 30 in regards to an alleged bomb threat at the 1- 40 Travel Stop. This is where their knowledge and training pays off—We appreciate you!

They have put in volunteer hours to help make a difference in the city and in the community.
Some of you may not even know that there is an old cemetery located behind the North Franklin County Fair Building. The office was contacted last week asking if it could be cleaned up. Thank you to Julie & Wetzel Gilbreth and Daniel Elder for your dedication to this area even though it isn’ t a city cemetery. These three citizens made a difference!
A special thanks to Senator Gary Stubblefield, Senator John Boozman, Senator Tom Cotton and Congressman Bruce Westerman for honoring our area law enforcement with a dinner last Thursday evening.
A great day in the park was held last Sunday for our Wheelchair Swing dedication. Attending were numerous citizens, Bailey Farms, Hope Church,, Sarah Rodriguez from the Chamber of Commerce, City Council members Aerial Nicely, Randy Melton, Charlie Meeker, and Susan Holman, the Hall family and Brittany West.
There were 57 participants in the Fall Clean- Up held at the Transfer Center. Everyone was very pleased with the service provided. Jerry Banning helped several elderly citizens by picking up and bringing in their discarded items. Overall, the Clean- Up was very successful.
A motion was made by Randy Melton to adjourn and seconded by Aerial Nicely. All Alderpersons voted aye and the meeting was adjourned.
