Ozark City Council Meeting, Special Session

Present were Patterson, Holman, Anderson and Hall. Absent: Warden

Mayor McNutt called the meeting to order.
Jody reported by handing out two bids, one from Blackstone for $114,157.75 and one by Silco Const for $114,927.00. Jody said River to 7th street is our worst streets.
October, we put out for bids and opened them on Oct 17. Only two bids were turned in. Silco being the low bid.
Jody said he has $82K left in 2018 for paving but he expected an $80K bid.
Patterson asked if we included paving the OCC parking lot if we could get a better deal.
Anderson said this was a timing issue.
Hall said there is a big difference in pricing of the two bids. Jody said the stretch is 2500 feet long and 26’ wide.
Dwayne asked if it had to be done now. Jody said the longer we wait the more that will need to be done next year.
Rex wants to get it cheaper. Jody said one option would be to shorten the length of the repair and do a portion.
Susan says to put more in paving if we wait. Patterson motioned to reject all bids and wait until next year’s budget to appropriate funding to do the job. Anderson seconded that motion. On a roll call vote the following voted: Aye: Patterson, Holman, hall, Anderson, waters. No Nays.
Next was sanitation.
We previously met on the 22nd but Jeff talked to council and advised we rebid.
Susan asked if Altes could back out? Jody says in contract we have a performance bond we could collect. Jim Goodman said he wouldn’t leave us holding the bag.
If we rebid, we will put it in the swtimes on the 27th-the 10th and run it for two weeks. We will discuss it at the regular meeting in November.
George Wheatly asked why we recommend a rebid. Mayor McNutt said we left some parts out.
Waste management was the low bidder. Numbers are exposed so he feels he’s at a disadvantage. Susan said we must go with our legal council’s advice.
Dietz feels were here because waste management didn’t do their job to begin with. Jody asked if we need to vote to reject bids.
We need to recent previous bids. Mayor said cheap isn’t the issue. The goal is service. Dwight asked Mr. Wheatly did he not fill out an addendum?
Susan said she wanted to go on record stating we pay our city attorney a lot of money and she’s tired of him not being here! She isn’t sure if we need to vote to reject bids or not!
Anderson wants to follow legal action. We need clarification or take no action. Susan got Jeff Phillipson the phone, but he didn’t answer. Jeff called back and said we need to comply with the rules and rebid. We do not need to reject the bids. We need to undo our mistakes. We didn’t follow our own rules.
Was our addendum being the issue. Needed to run 5 days -only ran 2 days in the paper. He says we need to do it over.
Susan moves to open for rebids per our contingent mistake. Hall seconded the motion. On a roll call vote the following voted: Aye: Patterson, Holman, hall, Anderson, waters. No Nays.
